As you can expect, I won´t get an answer from those companies, I just wanted them to be aware, is up to the EE staff to know what those companies think about it, perhaps it is good news, perhaps not.

I can´t provide here any answer from those companies, as I won´t get any because I am just a customer doing a question that is not of my business. But those companies will investigate, and now know the answer to that questions anyway.

The EE staff can personally send emails to the legal department of Nintendo and Facebook if they want to (And it seems that they won´t which is a shame). If they do so, they will get a legit answer from Nintendo and Facebook.

And to clarify, I fully support this game, not neccesarily the staff (Might support the staff as the staff support the game too).

EE was an app on Facebook back in September 2010, and I think I remember hearing about Chris Benjaminsen working with Facebook on something later on, so clearly Facebook was well aware of the game and never did anything about it using the smileys. The main issue with them is that they're obviously not usable at larger sizes.

Nintendo of course is a different matter and not worth even the slightest risk.

With any of the graphics it could be seen as weird and cheap to use unoriginal graphics when original versions can easily be made (and for the most part they have been made).

Nintendo, one of the companies most litigious and protective of their IP. And you didn't think they'd care? If they ever *actually* become aware of it, it'll be big trouble for EE, and mostly EEO. If they get one of those companies' attentions, EE has no choice but to immediately fold. Likely a cease and desist to stop distributing any and all copies of EEO. For a random group of people glued together, as long as nobody's real identity is tied to it, who cares. But EE is a company, they'll can't just flip off the law or they'll be torn apart.

Nintendo getting aware of EE franchise is unavoidable, better soon than later.
Comfronting them now might be more reasonable than waiting Nintendoto do so when EEU is in the peak of popularity.

1. Highly avoidable. It's almost guaranteed that even with your email, it's not going to happen. That's how avoidable it is. "Inevitable" is completely baseless.

2. That's not how it works. It starts with a cease and desist, and then EEO goes poof. That's it. If you succeed in doing anything, it's in nuking EEO. You won't have even succeeded in forcing the game to get a lawyer, because they will simply comply with the cease and desist without a fight. You cheated not only the game, but yourself. You improved nothing. You gained nothing. You experienced a hollow victory. It's sad that you don't know the difference.

3. Importantly, there is no benefit to doing that. You are not going to get permission from Nintendo for their graphics. So, and this is a very important question, why did you email them?

Yeah no. You don't get to do that. EEU does not want to use the blocks. They won't. Whatever this stunt is, it won't change anything. The best case scenario is that EEO is nuked out of existence. I don't know if you can fall any further behind, but you should stop while you may or may not be ahead. You aren't helping.

I don´t consider this to be a bad thing for EE but a chance to stop fearing of it´s own shadow.

Again, I mailed them to finally figure out what do they think about all of this, to accelerate the process.
And I don´t expect anyone to be happy about it, but as you said, I did nothing, this situation of Nintento knowing of EE is something that was going to happen anyway.
