Do you think I could just leave this part blank and it'd be okay? We're just going to replace the whole thing with a header image anyway, right?

Re: Dear Staff, get a lawyer

As you can expect, I won´t get an answer from those companies, I just wanted them to be aware, is up to the EE staff to know what those companies think about it, perhaps it is good news, perhaps not.

I can´t provide here any answer from those companies, as I won´t get any because I am just a customer doing a question that is not of my business. But those companies will investigate, and now know the answer to that questions anyway.

The EE staff can personally send emails to the legal department of Nintendo and Facebook if they want to (And it seems that they won´t which is a shame). If they do so, they will get a legit answer from Nintendo and Facebook.

And to clarify, I fully support this game, not neccesarily the staff (Might support the staff as the staff support the game too).

Re: Dear Staff, get a lawyer

EE was an app on Facebook back in September 2010, and I think I remember hearing about Chris Benjaminsen working with Facebook on something later on, so clearly Facebook was well aware of the game and never did anything about it using the smileys. The main issue with them is that they're obviously not usable at larger sizes.

Nintendo of course is a different matter and not worth even the slightest risk.

With any of the graphics it could be seen as weird and cheap to use unoriginal graphics when original versions can easily be made (and for the most part they have been made).

"As far as Im aware, the EE staff is not considering creating any new graphic related nor based from Nintendo graphics and consider it a fault that wants it to be forgiven by Nintendo."

Yes, yes, just ignore my post, I didn't say anything that directly contradicted that statement or anything

Re: Dear Staff, get a lawyer

Nintendo, one of the companies most litigious and protective of their IP. And you didn't think they'd care? If they ever *actually* become aware of it, it'll be big trouble for EE, and mostly EEO. If they get one of those companies' attentions, EE has no choice but to immediately fold. Likely a cease and desist to stop distributing any and all copies of EEO. For a random group of people glued together, as long as nobody's real identity is tied to it, who cares. But EE is a company, they'll can't just flip off the law or they'll be torn apart.

N1KF wrote:

Minisaurus is defending this as fair use (or fair dealing, since EE isn't based in the United States to my knowledge).

This is a *major* problem. Fair use is not a right, it is a defense when you're being sued for copyright violations. EE will never get far enough to make a defense of any kind, if they receive notice from any outside company they pretty much have no choice but to immediately comply. The copyright system is bad and wrong, but it is fatally stupid to poke that bear.

I don't get it - why tattle to Nintendo like that? Are you actively trying to get the game killed?

Some people have been saying for quite a while "just let the game die"

I guess he got tired of waiting.

Would you better like to wait until EEU gets popular so then Nintendo sues EE franchise and get in debt because of EEO, sure waiting for what is inevitable is an option too, but I just accelerated what was going to happen anyway.

Nintendo getting aware of EE franchise is unavoidable, better soon than later.
Comfronting them now might be more reasonable than waiting Nintendoto do so when EEU is in the peak of popularity.

Re: Dear Staff, get a lawyer

I'm sure a mega-corporation, like Nintendo, is worried about a game with <20 players.

EE's cutting into their trillions.

Nintendo getting aware of EE franchise is unavoidable, better soon than later imo.

1. Highly avoidable. It's almost guaranteed that even with your email, it's not going to happen. That's how avoidable it is. "Inevitable" is completely baseless.

2. That's not how it works. It starts with a cease and desist, and then EEO goes poof. That's it. If you succeed in doing anything, it's in nuking EEO. You won't have even succeeded in forcing the game to get a lawyer, because they will simply comply with the cease and desist without a fight. You cheated not only the game, but yourself. You improved nothing. You gained nothing. You experienced a hollow victory. It's sad that you don't know the difference.

3. Importantly, there is no benefit to doing that. You are not going to get permission from Nintendo for their graphics. So, and this is a very important question, why did you email them?

How do you not realize that the people who own and operate EE have been telling you for days that EE did something wrong?  Seriously.

Over the past 10 years, no one cared, but now that the game is on life support, Nintendo is going to lose their ****.

You are the only one who believes EE did nothing wrong. Everyone else is playing it safe. You are the one attempting to poke city-block-sized bears. Everyone else wants to leave those bears alone and do everything they can to keep them asleep.

Re: Dear Staff, get a lawyer

It has been 10 years, nothing happened.
Why would something happen now?

I consider this to be a positive chance to get those fears to fade away.
It seems that nobody want those fears to fade away, sorry if being intrusive, not my intention to do wrong, just trying to help.

Yeah no. You don't get to do that. EEU does not want to use the blocks. They won't. Whatever this stunt is, it won't change anything. The best case scenario is that EEO is nuked out of existence. I don't know if you can fall any further behind, but you should stop while you may or may not be ahead. You aren't helping.

Nintendo was going to notice EEO eventually, why wait?

Whover who thinks that this will would never happen is fooling themselves.

Okay now you've leapt from position to position so much you're looping back around. If that's what you're going to do I can just start quoting my posts from the last time you were at this point in the loop.

And I know you didn't actually address any of anything in my post, you just leapt to the next position, but out of sheer optimism I'm going to highlight that last part:

Why did you email them? What did you hope to accomplish?

Re: Dear Staff, get a lawyer

And is that something bad?
I don´t consider this to be a bad thing for EE but a chance to stop fearing of it´s own shadow.

Again, I mailed them to finally figure out what do they think about all of this, to accelerate the process.
And I don´t expect anyone to be happy about it, but as you said, I did nothing, this situation of Nintento knowing of EE is something that was going to happen anyway.
