It's a good thing you don't expect anyone to understand, because it's quite impossible as you don't make any sense. The only reason you have to apologize right now is for being a headache for a lot of people. If EEO somehow ends up being taken down or changed because of your harebrained letter to Nintendo (Facebook won't see it for sure), then yes, it is entirely your fault for bringing to their attention a tiny flash game they never would have seen otherwise.

The graphics were stolen. The game doesn't want to reuse them.
EEU is doing good in not reusing graphics and try to avoid those, but what if EE actually has the right to reuse those graphics?
EEO will have those "stolen" graphics, EEO might perhaps be fined and therefore EEU won´t exist.
Why not solve this now, are you expecting one of the biggest companies in the world to not notice that a raising game (EEU) has EEO with it´s possibly stolen graphics?
All these people here don't understand the true power Minisaurus possesses. His plan is obvious. For a while now, he has been testing his lawyering skills by making really long and barely comprehensible posts discussing useless topics. If you've ever read a legal document, you should see my point already. He wants staff to get a lawyer because he is the perfect lawyer. Staff will have to choose him, but the ingenuity of this man does not stop here. Sure, a judge might find the comparison of Nintendo shutting down everything left and right to a tardigrade ruthlessly consuming algae, but that won't let EE win. Well, he doesn't want EE to win.
He wanted EE and EEU to use his graphics, but we know that a lot of graphics likely never were implemented because he suggested things like the blood pack publicly even as staff. Suddenly, it all starts to come together: he wants his graphics to be implemented into EEO to replace the stolen ones, and this is his way to force Xeno's hand. When the Nintendo Ninjas come after EE, our Savior Minisaurus, who so graciously defended us from the tyrants, even after he was shot down by their legal team, will be here to guide us, and we will listen - because these aren't just normal graphics; these are the graphics of his dreams. His blood, sweat, and tears have gone into these graphics. They are the Mona Lisa of our time. He will introduce them to us, and we will eat it up. At this point, he will already be a true hero. He will have defended EE and have provided it with his graphics in a time of need. Still, his plan does not end here.
Eventually, he will sue EE for using his graphics, and he will double Xeno's net worth to -800,000 gems by doing so. However, I bet he has been doing freelance work as a graphics artist this whole time, amassing a huge fortune. He will offer to buy EE from Xeno, and then he will finally be in control of the game. Not only has he saved us twice, he's freed us from Xenonetix. As owner, what will he do? It's obvious. Add the blood pack to EEU. Then finally, he will be able to rest, and peace will be restored to the universe.

Actually I will contact with an University that provides law advice in my city so I can clarify those aspects if the staff is so incapable to do it themselves.
Just for fun tho, I won´t provide here any legal advice that I got, this is truly intriguing me too.
I'm really enjoying the situation Minisaurus has put us in. It's a poetic conflict of hope and despair. As a fellow agent of optimistic chaos, my respect for Minisaurus has gone up.
Different, as far as I know the staff haven't made official plans to change the graphics of EEO. So to some extent, yes we do want copied graphics (or stolen, as you describe them).
So what if Nintendo sues Everybody Edits? Why on earth would you need to take the entire game down if only some graphics violate copyright? If Nintendo's legal team actually expects smiley face game to destroy itself because of a few graphics then they are way overstepping their boundaries. And they'd be chumps. EE does not back down to chumps. We must die with dignity.

As far as I'm aware, EE doesn't use any Nintendo assets. It uses edited versions of their assets.
