MARIO HAS CHANGED PRETTY MUCH ALL OF ITS TEXTURES in the latest versions like the U edition and junk it doesn't look like that, not many modern Mario games resemble Benjamin's Mario copy thingy and EE hasn't been sued yet. Why do you guys want to destroy the (pretty much) only remains of EE's older versions?
And? Mario has changed. EE must change too.

You forget that these:
are from 2010 and several smiley and block packs that are from 2010/2011 are unchanged.
Also Beta hasn't been touched (except for when they added the new basic colors) since 2010 either.

I think that the reason Everybody Edits hasn't been sued is that because it's such a small target. If the game were to expand, actual legal issues could arise. While a few blocks are certainly potential targets (brick, metal, and grass being most obvious), I really don't think basic is a problem. It's just a generic metal block with screws on each corner.

We're still playing the same game, however. The more we fiddle around with the basics, the less recognizable it will be. Also, Super Mario Bros. is over thirty years old, where as this isn't even seven. Most of the current graphics we have (well, at least the blocks) aren't made outdated by more graphical capabilities.

The sprites were ripped from New Super Mario Bros, which was released in 2006.
Wow, I didn't realize until now how similar the basic blocks are to the metal blocks. Either way, it's still possible to update them without having to remove the screws on the corners.

I leveled the colors of the bricks.
They might look too bright, but that's basically how the bricks had to be from the start.

I don't know which metal blocks you are referring to but the blocks labeled "Metal" in ee (The same as HG's retextured) are ripped from Super Mario World. Woops.
