Even assuming Phil decides when he does it, if Jeff is not allowed to do this then we have no idea what choice he would make. This does not allow us to actually compare the people, we are merely comparing their representations on TV in accordance with the rules or standards of their respective shows.

Are you sure it isn't just the show does not allow Phil to do that?

Maybe Phil is perfectly able to do that and wants to but cannot because of a contract or something?
