Here's the scenario:

nubling123 joins forum
nubling123 posts a bit
nubling123 accumulates enough warnings to get a ban minus one
nubling123 makes an off topic post
nubling123 also makes a spammy post elsewhere
nubling123 is banned for a little while for spammy post

what should be done about nubling123's off topic post?

All posts that disobey the rules deserve a warning, even if they're already banned.

Raon wished death upon another user and he got his ban lengthened to a month and a week instead of just a week because death-wishing is bad.
