Were you kicking him correctly? As far as I know you can always kick someone, no matter what they have.
Ignore this if you know how, but you do this:

/kick 123 *message here*

Just get out of your level till he got bored then leave.
Or change the code.
And he can't ban you, he's just threatening you.
