I know Club Penguin allows open chat (mostly), and when you abuse the system you are downgraded to a system of quick chat. So not banned, just chat banned. What would be cool though, and I don't think it would be manageable in EE, but it would be cool to have 18+ rooms, where basically you can chat whatever you want, but you have to be a certain age to get in.
Obviously since EE is lacking any sort of age/e-mail verification this would never work, but just throwing it out there.

That's not true. Guardians wouldn't be half as bad if there was a player vote or consensus on who the guardians were going to be, like an election. For shoe to pick users though, without first consulting the community, definitely comes off as unfair and I can see why you would think having community moderators is a bad thing. It's only bad when the moderators are corrupt, bias, and/or generally disliked by the greater community.
IMO, to be a guardian you should have to fill out an application saying why you should be guardian, answering hypothetical questions, etc. MrShoe would then pick the 4 or 5 applications he thinks are the best.

Judging by the typical CoD multiplayer experience, 10-year-olds can easily be the most prone to swearing online.
I honestly don't think people should be banned or even kicked for merely swearing, unless the owner demands it on the last case. We are on the internet, where death threats and flaming run rampant, and placing a flash multiplayer game under a shell ain't gonna solve anything - and some people may be so used to swearing in the internet that they forget about these restriction in this game. You can also easily offend someone without swearing by things such as indirect threats (happens a lot in EE sometimes, I swear) or just having a different opinion (!).
Oh, and most swearing will be just "****" ingame anyway.
