You can take some of the blocks and smileys and the idea of the game, but original graphics and code are protected. If you built EE from the ground up it would be absolutely fine.

Making a remake that just alters graphics should be fine.

Private servers are not permitted.

I would assume using any of their graphics and code would in some form, be disallowed. Writing your own remake from scratch, with original graphics, even if it is the same idea, should be fine.

I quit the original game and I can see why others might now deserve an alternative server.

The best thing to do to avoid copyright notices is to host the actual server in Sweden, as they have better copyright laws than the United States. You can also host it in less legally-active places such as Afghanistan, Spain or possibly Russia as long as the United States and Russia have sanctions.

If there are issues, or if you are cautious, you can run the server under a proxy.
You might not be able to use PlayerIO/GamesNET, as Chris partially owns it.
Chris doesn't seem to care about Everybody Edits anymore to that point, but nobody can be certain.

If you're serious about it, you'll face the issue of having to create another server for it.
However, after a few weeks of researching you'll possibly discover that you can modify the flashbridge to possibly act nicely with a locally hosted development server. Or, with a custom server if you want to take it that far.
