You can't possibly blame Ernesdo for you being a jerk and for taking his work without permission. You can't just do some scummy **** like this and then when you are (eventually) confronted about it you shift the blame over to someone else just because you can't take the backlash.

If someone tells you that you can't use his graphics, it means exactly that, don't use their graphics. This also includes ''changing'' their graphics. It doesn't matter how much you change someone's graphics, it will always be theirs. And clearly you don't care about that since:

I have created a blank 16x16 graphics. Since now, all 16x16 Graphics count as a modified version of mine. That means you're not allowed to create 16x16 graphics anymore!

Basically, if you create a 16x16 graphic, and edit it, it counts as modifiing my graphic.

Guys seriously! Every pixel of ernesdos image has been changed. If I didn't PM him, he wouldn't even get that. That's like if you build a phone on the template of iPhone, but modify it so, that only some of the cables stay, the entire outlook gets changed, and, possibly has 500 instead of 255 pixel variations per color. Somehow it's allowed to use the cables in the phone which Apple already uses. Like, if I make a FreeForums hosting server. That's allowed. If you use ProBoards as template, but remvoe all the settings, make the CSS so like being your own, ...

So pls. Reporting last time to close the topic.

If you modify a graphic, it still counts as a modify and you need to have the owner's permission.

Starting from nothing/scratch doesn't (afaik) count. (Unless you used the owner's graphic as an idea, you might need to credit him/her)

EDIT: I like the fact that rather than making your own graphic. You're still trying to modify Ernesdo's graphics and getting away with it.

We can discuss the merits or lack thereof considering intellectual property theft without attacking them for things outside the actions being discussed

and yeah that's a huge number but remember many nuances are visually the same but mathematically different

Well if he does completely remake the graphics, then it doesn't actually matter whether it was modified or done from scratch. What matters is the similarity between his graphics and the original graphics, and whether the similarity is insignificant enough for de minimis to apply. Obviously anatoly is still in the wrong for doing something like this without ernesdo's permission, but in terms of copyright law, from what I understand, we have to see the graphics in order to make a judgement.

EE has been rooted in the using of material from other companies to get a profit. However, that does not make any case of stealing artwork, even if heavily modified, acceptable. This is especially true when an individual makes their own graphics, no matter for recreation, to suggest or add a fan made object into something, or mostly any other reason. A giant company has many people working on and improving their graphics usually, or the creator is at least either fine with their assets being used (as it is across the company) or usually has not a reason to care too much or experience a loss emotionally or monetarily. The truth is that if you were to scrap graphics from most major companies and 'heavily edit them', you would be presented with a cease and desist. It may fall under copyright laws as legal either as a parody or some other type of fair use (though many don't care and will use their money and intimidation to abuse the law in their favor), but I'm not experienced enough in law to give a decisive answer. No matter what, using somebody else's assets despite their disapproval of it, no matter expressed or unexpressed, in a game or most other art forms is 90% of the time scummy. Exceptions do exist, but this is not one of them.
